SAN DIEGO, Jan. 24 — A former pharmaceutical executives man has been indicted by a federal grand jury for his role in a conspiracy to fix and manipulate the Food and Drug Administration’s Office of Price Controls.
Steven P. Dainan, 34, of Silver Spring, Maryland, pleaded guilty to conspiracy to fix and manipulate drug prices and to receive criminal forfeiture and fines of $8 million. He is scheduled to be arraigned today, U. S. District Judge Leslie S. Thomas said, at a federal court convenience in San Diego.
Dainan and two of his executives are charged in federal court in Chicago and San Diego with conspiracy to fix price changes and fix prices, one of the defendants in the case is charged with receiving criminal forfeiture and fines of $8 million, and one of the defendants is charged with conspiracy to fix and manipulate prices.
“These cases are a perfect combination of the strong defense of the defendant and the strong defense of the defendant’s role in this case,” Thomas said. “This case is the result of that defense.”
The defendant, Michael J. McKnight, a former president of the Department of Veterans Affairs, was convicted of conspiracy to fix and fix price increases in 2004.
The drugmaker was sentenced to $1 million in forfeiture, fines of $8 million, and criminal forfeiture and fines of $10 million.
“This is not a case that is going to be very successful,” Thomas said. “This case has been very successful and it has resulted in over $1 billion in criminal forfeiture and fines. It will be successful in the future.”
Mcknight faces a maximum of five years in federal prison and a maximum term of two years of supervised release in federal court in Chicago. He is scheduled to be arraigned today.
“This is a very strong case,” said Thomas. “In this case, they will definitely be able to recover the money they lost to the federal government.”
The defendant’s family, who are suing pharmaceutical companies, said they believe McKnight’s guilty plea is the result of “personal and improper” conduct. They say McKnight’s actions were not “extreme,” “especially in light of the high price of Viagra.”
Dainan, the former president of the Department of Veterans Affairs, was charged with a crime of introducing evidence of a drug that caused the deaths of two of McKnight’s employees.
Dainan is scheduled to be arraigned today, U. Thomas said.
